The Ness County Board of Commissioners met in regular session Tuesday, October 11, 2016, at 9:00 a.m. in the Commissioner’s Room. Chairman Sandra Y. Rupp called the meeting to order with Commissioners, Frederick P. Flax, David L. Albers, and County Clerk Renee S. Kerr in attendance.
Others Present Mark Davis, Republican Nominee for Commissioner, was also present for the meeting.
Minutes Minutes of the October 3, 2016 meeting were read and approved.
Road and Bridge: Road and Bridge/Landfill Supervisor Ron Johnson reported on the weekly work schedule. $190.00 was taken in at the landfill as tipping fees September 27-October 1, 2016. Culverts, auto gates, and mowing were discussed. Road concerns were reviewed. Machinery maintenance was discussed.
Motion: Upon the motion of Flax, seconded by Rupp, the Commission voted unanimously to go into executive session for a period of 10 minutes beginning at 9:52 a.m. for the discussion of nonelected personnel. (Albers, Flax, Rupp and Johnson in executive session). Regular session resumed at 10:02 a.m.
Economic Development: Economic Development Director Anthony Roy filed his activity report for the past two weeks. Roy researched FEMA grants, met with Lea Ann Seiler Hodgeman County Economic Development Director, hosted a Coalition Meeting, completed required KDADS grant, and posted job listings on Western Kansas Jobs. Roy reported that the Bazine Co-op was approved for the EDX exemption.
Executive Session Motion: Upon the motion of Flax, seconded by Albers, the Commission voted unanimously to go into executive session for a period of 10 minutes beginning at 10:37 a.m. for the discussion of nonelected personnel. (Albers, Flax, and Rupp in executive session). Regular session resumed at 10:47 a.m.
Daily Statement: Daily Statements for the month of September were reviewed and signed.
Accounts Payable: Accounts Payable checks and vouchers were reviewed and signed.
County Attorney: County Attorney Craig Crosswhite and the Commission discussed DUI levels, delinquent tax sale, a leasehold property sold at the delinquent tax sale, and road petitions.
Resolution Motion: Upon the motion of Flax, seconded by Albers, the Commission voted unanimously to sign Resolution 2016-10.

RESOLUTION ORDERING TAX SALE NOW on this 11th day of October, 2016, the Board of County Commissioners of Ness County, Kansas meet in regular session at the Commissioners' Room of the Ness County Courthouse, Ness City, Kansas, with Chairman Sandra Y. Rupp presiding, and Commissioners Frederick P. Flax and Dave Albers present.
WHEREAS pursuant to K.S.A. 79-2801, the Board of County Commissioners may, in their discretion, order the County Attorney to institute an action for the judicial foreclosure and sale of real estate for delinquent taxes; and
WHEREAS the Board of County Commissioners has determined that it is in the best interest of Ness County to pursue such tax sale; and
NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF NESS COUNTY, KANSAS that the Ness County Attorney shall institute an action in the District Court, in the name of the Board of County Commissioners of Ness County, Kansas, against the owners or supposed owners of real estate which have delinquent taxes within the meaning of K.S.A. 79-2801.
